Commissionable Rates
All rates are non-commissionable with the exception of a 15% commission for camera ready advertising, to recognized advertising agencies. The commissionable rate is based on the one-time rate regardless of frequency.
Payment Terms
  1. First-time ads must be accompanied by full payment at time of order.
  2. A credit application must accompany all contract accounts.
  3. Payment of subsequent ads are due upon receipt of invoice.
  4. Accounts 45 days overdue may be turned over to a collection agency.
  5. A service charge of 1˝% (18% annual percentage rate) will be applied to any charges not paid within 30 days of invoice.
  6. CareerSource accepts MasterCard, Visa and American Express.

Inside front cover, center spread or inside back cover will be charged 15% extra. Back cover is an additional 20%.

Terms & Conditions
  1. Advertiser agrees to all terms as stated in rate card.
  2. If contracted frequency is not fulfilled for any reason, the advertiser will be short rated at the highest applicable rate. Any ad cancellation will be billed in full at contracted rate. A 60 day written notice must be given prior to publication date to cancel contract or space agreement.
  3. Yearly contracts shall be automatically renewed for each period thereafter unless either party gives written notice to the contrary (60) days prior to the anniversary date.
  4. CareerSource reserves the right to refuse an ad for any reason.
  5. All ads built by CareerSource become our property and cannot be reprinted in any other publication without written permission from the publishers.
  6. CareerSource may revise its advertising rate schedule at any time upon 30 days written notice to the advertiser.
  7. If the advertiser utilizes an agency, the advertiser and the agency shall be jointly and separately liable for payment and for compliance with all of the terms of this agreement.
  8. CareerSource will not be held responsible for any loss to advertiser that results from the incorrect publication of its advertising.
  9. Cancellation of advertisement must be made to applicable deadlines, or space will be charged at applicable rate.
  10. If CareerSource has to utilize the services of an attorney, collection agency, paralegal, or process server, in order to collect monies owed, advertiser will pay all necessary fees/charges/costs incurred in the pursuit of collecting of monies owed. Said fees/charges/costs pertain to the following collection actions: Prepare court forms, filing of court forms (court fee and courier fee), obtain business name/location/owner information and business form information (ascertaining entity type, i.e., corporation, partnership, etc.) from city business license divisions, fictitious business offices, Secretary of State, and Limited Partnership Offices, public records searching (i.e., DMV, Social Security Checks, court records), when said records are accessed in order to locate and serve the advertiser with court papers, photocopying, long distance charges, and postage fees which are incurred to accomplish the above listed actions.
  11. In any action to enforce the terms of this agreement, the prevailing party should be entitled to recover its attorney fee & court costs & other nonreimbursable litigation expenses.
  12. All manuscripts submitted at owners risk. All become property of the publishers.
  13. Credit adjustments for errors shall not exceed the cost of the space occupied by such error. Credit for errors will not be given after the first insertion on multiple insertions. There will be no adjustments, except in extreme circumstances, for ads that do not publish on the scheduled date. There will be adjustments for camera-ready ads, or for text errors in ads received by remote-entry from agencies. Finally, requests for credit made in excess of 90 days after the ad appeared will not be granted.
  14. Claims for adjustments must be made within seven days of publication. The publisher assumes no financial responsibility for typographical errors or omission of copy. If there are disputes or discrepancies with the published advertising, the customer may deduct only the amount in question from the charge and pay the balance according to terms.
  15. Advertiser agrees that the placement and publication of advertising is governed by the Laws of the State of California. Advertiser agrees that the City of San Jose and the County of Santa Clara, in which CareerSource is located shall be the forum for any legal action relating to advertising placed or published.
  16. Advertiser and/or advertising agency agrees to protect and indemnify CareerSource against any and all liability, loss, or expense arising from claims of libel, unfair competition, unfair trademarks, trade names or patents, violation of rights of privacy and infringements of copyrights and propriety rights resulting from the publication of the advertisers’ advertisements.
